In this notice, "you" means each person who signs this application (the applicant and any co-applicant), and "we" and "us" mean Harbor & Trail Powersports.
1. AUTHORIZATION TO OBTAIN CONSUMER REPORTS. By signing, you authorize us, and any lender, finance company or other financial institution to which we send your application, to obtain one or more consumer reports (credit reports) about you from consumer reporting agencies, and to verify the information you gave us (including your employment, income and residence), now and later in connection with this application and any account or contract that results from it, including to review, update, renew or collect it.
2. SHARING YOUR APPLICATION WITH LENDERS. You understand that we do not ourselves decide whether to extend credit. We are applying on your behalf to arrange financing for the purchase of a vehicle. You authorize us to send your application and the information in it, and the information in any consumer report about you, to one or more prospective lenders that we select, and to receive their decisions and related information from them. Several lenders may review your application and request a consumer report, which may appear as more than one inquiry on your credit report. We may receive compensation from a lender if a contract is entered into.
3. EQUAL CREDIT OPPORTUNITY ACT NOTICE. The federal Equal Credit Opportunity Act prohibits creditors from discriminating against credit applicants on the basis of race, color, religion, national origin, sex (including sexual orientation and gender identity), marital status or age (provided the applicant has the capacity to enter into a binding contract); because all or part of the applicant's income derives from any public assistance program; or because the applicant has in good faith exercised any right under the Consumer Credit Protection Act. The federal agency that administers compliance with this law concerning most dealers and finance companies is the Federal Trade Commission, Equal Credit Opportunity, Washington, DC 20580; each lender will tell you the agency that oversees it. You do not have to disclose income from alimony, child support or separate maintenance payments if you do not want it considered in repaying this obligation.
4. FAIR CREDIT REPORTING ACT NOTICE. If your application is denied, or credit is offered on terms less favorable than you asked for, based in whole or in part on information in a consumer report, you will receive a notice (an "adverse action notice") from us or from the lender stating the reasons, the name of the consumer reporting agency, and your right to a free copy of your report within 60 days and to dispute its accuracy. If you ask in writing within 60 days, we will tell you the nature of any information obtained from a source other than a consumer reporting agency on which a denial was based.
5. ELECTRONIC SIGNATURE, RECORDS AND COMMUNICATIONS. You agree to sign this application electronically and to receive this notice, and notices and disclosures about this application (including any adverse action notice) electronically, under the U.S. Electronic Signatures in Global and National Commerce Act (E-SIGN) and the Uniform Electronic Transactions Act (UETA) as adopted in the governing state. Typing your full name and ticking the boxes is your signature and has the same effect as a handwritten signature. You may ask us for a paper copy at no charge, and you may withdraw your consent to electronic records by contacting us; withdrawing does not affect the validity of this application. To view and keep these records you need a device with a current web browser; you can print or save this page. We keep an exact copy of the text you accepted, with the date and time.
6. PRIVACY. Our privacy notice explains how we collect, use, share and protect nonpublic personal information under the federal Gramm-Leach-Bliley Act, and how you can limit certain sharing. You can read it at https://demo.motodealerhq.com/privacy. We protect your Social Security number and financial information with encryption and restrict who can see it, use it only to process your application and any resulting financing, and delete the sensitive details after the period described in our privacy notice unless the law requires us to keep them longer.
7. CERTIFICATION OF ACCURACY. You certify that you are at least 18 years old (or the age of majority where you live), that the information in this application is true, correct and complete, and that you have not left out any information that would affect it. You understand that knowingly giving false information on a credit application is a crime under federal law (18 U.S.C. 1014) and may be under state law. You agree to tell us promptly if any of the information changes before financing is completed.
8. JOINT APPLICATION. If a co-applicant signs this application, each of you states that you intend to apply for joint credit, and each of you authorizes the actions above for yourself. Each person who signs is responsible for the accuracy of their own information.
9. NO GUARANTEE. Submitting this application does not mean you are approved, and it does not oblige you to accept any credit offer or to buy a vehicle. Rates, terms, down payment and approval are set by the lender.
Questions: contact Harbor & Trail Powersports (fictional), (231) 555-0151.
By selecting “Submit application” you sign this application electronically. Submitting does not commit you to a loan or a purchase.
